APIL defends no win no fee for medical negligence

The Association of Personal Injury Solicitors (APIL) have argued that there is no evidence that no win no fee arrangements for medical negligence claims is behind the increase in claims against the healthcare profession.

In a letter to the Law Society Gazette, APIL rebutted the allegation by the Medical Defence Union (MDU) that the existence of no win no fee arrangements for funding of medical negligence claims was a factor in the increasing number of claims.

It was pointed out that the National Patient Safety Agency found an increase in the number of patient safety incidents last year.

Swain & Co.’s personal injury and medical negligence solicitors support the APIL viewpoint, and back them in the criticism of the MDU’s plan to campaign for the level of patients’ compensation to be reduced.

As we highlighted in our post ‘Petition against medical negligence legal aid levy’, medical negligence claimants could be facing a loss of up to 25% of their awarded damages for pain and suffering once the Legal Aid, Sentencing and Punishment of Offenders Act has been implemented.

Further reductions or caps could see victims of medical negligence not receiving the compensation they deserve for pain and suffering of injuries caused through no fault of their own.
